This Sweepstakes is open to legal residents of any one (1) of the fifty (50) United States or District of Columbia and are at least 18 years old and the age of majority in their state or jurisdiction of primary residence.

 

By entering this Sweepstakes, you agree to these Official Rules, which are a contract, so read them carefully. Without limitation, this contract includes indemnities to the Sponsor from you and a limitation of your rights and remedies.

Note that the “ARBITRATION AGREEMENT” section below contains provisions that require, where permitted by law, all disputes arising out of or relating to participation in this Sweepstakes – with limited exceptions – to be resolved in binding arbitration, and not in court, and that you and ALDI Inc. waive the right to bring or participate in a class action in connection with such disputes. Please read the ARBITRATION AGREEMENT carefully. By participating in the Sweepstakes, you hereby agree to be bound by the ARBITRATION AGREEMENT.

  1. OVERVIEW: 
    The ALDI’s a Chance to Win a $500 Gift Card Sweepstakes for the ALDI Store noted above is available during the Store Hours and Sweepstakes Period noted above. During the Sweepstakes Period, eligible participants (see ELIGIBILITY section) can enter for a chance to win the Grand Prize (see PRIZE & APPROXIMATE RETAIL VALUE (“ARV”) section) by following the instructions in the HOW TO ENTER section below. Entry into this Sweepstakes does not result in entry into any other sweepstakes offered by Sponsor.
     

  2. SPONSOR:
    This Sweepstakes is sponsored by ALDI, Inc., 1200 N. Kirk Rd., Batavia, IL 60510 (“Sponsor”).

  3. ELIGIBILITY:
    This Sweepstakes is open to legal residents of one (1) of the fifty (50) United States or the District of Columbia who are at least 18 years old and the age of majority in their state of residence at time of entry (the “Territory”). Employees, officers, directors, members, managers, agents, and representatives of Sponsor or Weber Shandwick, or their respective corporate parents, partners, divisions, subsidiaries, affiliates, assigns, and successors in interest, each of their respective advertising, promotion and public-relations agencies, and any other party participating in the development, design, administration, or fulfillment of this Sweepstakes (collectively, the “Released Parties”), and the immediate families (defined as any spouse, partner, parent, legal guardian, sibling, child, legal ward, grandparent, or grandchild, regardless of where they reside) and members of the same household (whether legally related or not) of each such individual, are ineligible to participate or win the prize in this Sweepstakes. Participation in this Sweepstakes constitutes participant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor.
     

  4. HOW TO ENTER:
    During the Sweepstakes Period, to receive one (1) entry, eligible participants must complete and submit the online entry form available by scanning the Quick Response Code (the “QR Code”) for this Sweepstakes posted on signage at the ALDI Store during the Sweepstakes Period. Participants may ask an ALDI associate at the ALDI Store for help scanning the QR Code during Store Hours.

    Each participant must complete the Entry Form by submitting their (1) full name; (2) street address; (3) phone number; (4) email address; and (5) acknowledgment of these Official Rules and ALDI’s Privacy Policy (available at https://www.aldi.us/en/online-privacy-notice/). The Entry Form must be completed and successfully submitted by participant during the Sweepstakes Period. Only completed registrations actually received by Sponsor during the Sweepstakes Period will render the participant eligible to participate in this Sweepstakes. All entries become the sole property of the Sponsor and will not be returned.

    Limit one (1) entry per person and household for the entire Sweepstakes. Any participant who attempts to participate multiple times (e.g., submitting the Entry Form more than once or using multiple identities) is in violation of these Official Rules and may be disqualified. Any purported entries that are incomplete or completed/received outside of the Sweepstakes Period will be void. Sponsor’s determination of eligibility and the earning or failure to earn an entry into the Sweepstakes will be final and binding on all participants. Purported entries that are fraudulent, forged, altered, incomplete, lost, late, misdirected, mutilated, illegitimate, incomprehensible, garbled, or generated by a macro, bot, or other automated means will not be accepted and any purported entry earned thereby will be void. Entries or participation made on behalf of any other individual or any entity or group will be declared invalid and disqualified for this Sweepstakes. If there is any technological error or difficulty with the Sweepstakes, Sponsor reserves the right to suspend the Sweepstakes and refuse to award any associated prizes until the technical difficulties are resolved to Sponsor’s satisfaction.  In the event of a dispute about the identity of an entrant, Sponsor may disqualify the entrant in its sole discretion. Sponsor is the official timekeeper for the Sweepstakes. By entering the Sweepstakes, each participant agrees to be bound by these Official Rules or the instructions of Sponsor or its representatives, whose decisions are final and binding on all matters relating to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements in these Official Rules. As a condition of entering the Sweepstakes, without limiting any other provision in these Official Rules, each participant gives consent for Sponsor and its agents to obtain and deliver their name and other information and content to third parties for the purpose of administering this Sweepstakes and complying with applicable laws, regulations, and rules.
     

  5. WINNER SELECTION/NOTIFICATION:
    Within approximately seven (7) business days after the conclusion of the Sweepstakes Period, Sponsor will conduct a randomized drawing to select one (1) potential winner (“Winner”) from among all eligible entries received throughout the Sweepstakes Period. Odds of being selected depend on the number of eligible entries received.

    The Winner will be notified by mail, phone, and/or email within approximately ten (10) business days of the drawing. The Winner must respond to such notification accordance with Sponsor’s instructions within seven (7) business days (or other time frame as indicated in Sponsor’s notification to the Winner). Sponsor reserves the right to choose an alternate winner in the event that a potential winner has been disqualified or is deemed ineligible (including, without limitation, if an attempted notification or prize is returned as undeliverable), in Sponsor’s sole discretion. As a condition of receiving the Grand Prize, the Winner may be required to complete and sign an Affidavit of Eligibility, Liability and Publicity Release (unless prohibited by law), any required tax documentation, and any other documents required by Sponsor (collectively, the “Winner Documents”). Failure to complete the Winner Documents in the form provided by Sponsor’s representative, and in accordance with Sponsor’s representative’s instructions, may result in forfeiture of the Grand Prize.

    Sponsor reserves the right to contact any participant for verification purposes and administration of the Sweepstakes. The Grand Prize, if legitimately claimed, will be awarded. Sponsor will not be obligated to pursue more than three (3) alternate winners for any prize.
     

  6. ​GRAND PRIZE & APPROXIMATE RETAIL VALUE (“ARV”):
    Subject to verification, one (1) confirmed winner will receive a prize consisting solely of one (1) five-hundred dollar ($500) ALDI gift card (the “Grand Prize”). Gift card is subject to all terms and conditions imposed on its use by its issuer, as specified on the gift card or in its accompanying materials, and is valid only in the U.S.A. for use at ALDI locations. ARV: $500. 

    All prize details not specified in these Official Rules will be determined by Sponsor in its sole discretion. Any taxes (federal, state, and local) and all other costs and expenses associated with prize acceptance or use and not specified in these Official Rules as being part of the prize will be the sole responsibility of Winner. Winner may be issued a 1099 and related tax forms for the actual value of the prize.  No more than the stated prizes will be awarded. Sponsor will not replace any lost, mutilated, or stolen prizes or prize elements or any prizes that are undeliverable or do not reach any Winner because of an incorrect or changed address or bank routing information. Sponsor is not responsible and will have no liability for Winner’s inability to accept or use the prize for any reason. If Winner does not accept or use the entire prize, the unaccepted or unused part of the prize will be forfeited, and Sponsor will have no further obligation with respect to that prize or portion of the prize. No transfers, cash redemptions, or prize substitutions will be made, except at Sponsor’s sole discretion. Winner is strictly prohibited from transferring the right to receive the prize, except with Sponsor’s permission, which may be granted or withheld for any reason in its sole discretion. Sponsor reserves the right to substitute any prize or portion thereof with another prize or portion thereof of equal or greater value for any reason, including unavailability of the stated prize. Each participant waives the right to assert as a cost of winning any prize any and all costs of verification and redemption or travel to claim the prize and any liability and publicity which might arise from claiming or seeking to claim said prize.
     

  7. RELEASE / INDEMNITY / LIMITATION OF LIABILITY:
    Each participant agrees to release, discharge, hold harmless, and indemnify each of the Released Parties from and against any claims, damages, disabilities, attorneys' fees, and costs of litigation and settlement, as well as any liability whatsoever, for injuries or damages of any kind sustained in connection with: (i) the Sweepstakes; (ii) the use, acceptance, possession, misuse or awarding of the Grand Prize; or (iii) while preparing for, participating in, and/or traveling to any Grand Prize-  or other Sweepstakes-related activity, including, without limitation, any injury, damage, death, loss, or accident to/of person or property.

    By entering the Sweepstakes, participant agrees that, to the maximum extent permitted by applicable law: (1) any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded, will be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards will be limited to actual third-party, out-of-pocket costs incurred (if any) not to exceed ten dollars ($10.00), but in no event will attorneys’ fees be awarded or recoverable; (3) under no circumstances will any participant be permitted to obtain any award for, and participant hereby knowingly and expressly waives all rights to seek, punitive, incidental, consequential or special damages, lost profits and/or any other damages (other than actual out-of-pocket expenses not to exceed ten dollars ($10.00)) and/or any rights to have damages multiplied or otherwise increased; and (4) participant’s remedies are limited to a claim for money damages (if any) and participant irrevocably waives any right to seek injunctive or equitable relief. 
     

  8. ​ARBITRATION AGREEMENT / GOVERNING LAW:
    Except where prohibited by law, as a condition of participating in this Sweepstakes, entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement, and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and entrant further waives all rights to have damages multiplied or increased.

    All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Illinois, USA.
     

  9. ADDITIONAL DISCLAIMERS: 
    The Released Parties are not responsible and/or liable for any of the following, whether caused by a Released Party, a participant, or by human error: entries that are submitted by illegitimate means (such as, without limitation, by an automated computer program) or entries in excess of any stated limit; any lost, late, incomplete, illegible, unintelligible, garbled, mutilated, or misdirected entry, email, mail, or Sweepstakes-related correspondence or materials or postage-due mail; any error, omission, interruption, defect or delay in transmission or communication; viruses or technical or mechanical malfunctions; interrupted or unavailable cable or satellite systems; errors, typos, or misprints in these Official Rules, any Sweepstakes-related advertisements, or other materials; failures of electronic equipment, computer hardware, or software; lost or unavailable network connections or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications or entry information. Released Parties are not responsible for electronic communications that are undeliverable or do not reach participant as a result of any form of active or passive filtering of any kind or insufficient space in an participant’s email or voicemail inbox. Without limiting any other provision in these Official Rules, the Released Parties are not responsible or liable to any participant or winner (or any person claiming through such participant or winner) for failure to supply the prize or any part thereof in the event that any of the Sweepstakes activities or Released Parties’ operations or activities are affected by any cause or event beyond the sole and reasonable control of the applicable Released Party (as determined by Sponsor in its sole discretion), including, without limitation, by reason of any acts of God, equipment failure, threatened or actual terrorist acts, air raid, act of public enemy, war (declared or undeclared), civil disturbance, insurrection, riot, epidemic, pandemic, Covid-19 or similar related issues, fire, explosion, earthquake, flood, hurricane, unusually severe weather, blackout, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, any law, rule, regulation, action, order, or request adopted, taken, or made by any governmental or quasi-governmental entity (whether or not such governmental act proves to be invalid), or any other cause, whether or not specifically mentioned above.
     

  10. GENERAL RULES:
    Sponsor’s decisions will be final in all matters relating to this Sweepstakes, including interpretation of these Official Rules, selection of the Winner, and awarding of the prize. All participants, as a condition of entry, agree to be bound by these Official Rules and the decisions of Sponsor. Participants further agree to not damage or cause interruption of the Sweepstakes and/or prevent others from participating in or engaging with the Sweepstakes. Sponsor reserves the right to restrict or void entries or other participation from any IP address or other identifiable source if any suspicious entry and/or participation is detected.  Sponsor reserves the right, in its sole discretion, to void the entry of any entrant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness, or proper play of this Sweepstakes. Sponsor’s failure or decision not to enforce any provision in these Official Rules will not constitute a waiver of that or any other provision.  In the event there is an alleged or actual ambiguity, discrepancy, or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials and/or these Official Rules (including any alleged ambiguity, discrepancy, or inconsistency within these Official Rules), it will be resolved by Sponsor in its sole discretion.  Participants waive any right to claim ambiguity in the Sweepstakes or these Official Rules.  If Sponsor determines at any time in its sole discretion that Winner is disqualified, ineligible, in violation of these Official Rules, or engaging in behavior that Sponsor deems obnoxious, inappropriate, threatening, illegal or that is intended to annoy, abuse, or harass any other person, Sponsor reserves the right to disqualify that Winner, even if the disqualified Winner may have been notified or displayed or announced anywhere.  The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules will otherwise remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. If the Sweepstakes is not capable of running as planned for any reason, Sponsor reserves the right, in its sole discretion, to cancel, modify, or suspend the Sweepstakes and award the prizes from eligible, non-suspect entries received prior to cancellation, modification, or suspension (if any) or as otherwise deemed fair and appropriate by Sponsor. If any person supplies false information, obtains entries by fraudulent means, or is otherwise determined to be in violation of these Official Rules in an attempt to obtain a prize, Sponsor may disqualify that person and seek damages from him or her and that person may be prosecuted to the full extent of the law. If a dispute cannot be resolved to Sponsor’s satisfaction, the entry will be deemed ineligible. Caution: any attempt to damage any online service or website or undermine the legitimate operation of the Sweepstakes may violate criminal and civil laws. If such an attempt is made, Sponsor may disqualify any participant making such attempt and may seek damages to the fullest extent permitted by law.

Information We Collect By Automated Means

When you use our Sites, we may collect certain information by automated means, using technologies such as cookies, web server logs, image pixels, web beacons and JavaScript.

Our Weekly Ads pages are operated by Fusion92 (“Fusion92”), whose own privacy policies apply to the collection, use and disclosure of information obtained through the Weekly Ads pages by Fusion92 and its partners (such as Fusion92 ad networks).  Fusion92 may use browser cookies, HTML 5 web storage, pixels and web beacons on our Weekly Ads pages.  Similarly, the collection, use and disclosure of information by social media sites in connection with ALDI’s social media pages and accounts, including on Facebook, Pinterest, Instagram, Twitter and YouTube, is subject to those sites’ privacy policies.

CALIFORNIA CONSUMER PRIVACY NOTICE

This California Consumer Privacy Notice (“Notice”) supplements the U.S. Online Privacy Notice. It applies solely to California consumers and addresses personal information we collect online and offline.  This Notice does not apply to Aldi Inc. personnel or job applicants.  

 

This Notice uses certain terms that have the meaning given to them in the California Consumer Privacy Act of 2018 and its implementing regulations (the “CCPA”).

  1. Notice of Collection and Use of Personal Information

         

We may collect (and may have collected during the 12-month period prior to the effective date of this Notice) the following categories of personal information about you:

  • Identifiers: identifiers such as a real name, postal address, unique personal identifier (such as a device identifier; cookies, beacons, pixel tags, mobile ad identifiers and similar technology; unique pseudonym, or user alias; telephone number and other forms of persistent or probabilistic identifiers), online identifier, internet protocol address, email address, account name, and other similar identifiers.

  • Protected Classifications: characteristics of protected classifications under California or federal law, such as race, color, national origin, religion, age, sex, gender, gender identity, gender expression, sexual orientation, marital status, disability, and military and veteran status.

  • Commercial Information: commercial information, including records of personal property, products or services purchased, obtained, or considered, other purchasing or consuming histories, tendencies, or preferences, information from communications that we exchange, including when you contact us with questions, feedback, complaints, or otherwise, research data that you provide when you agree to participate in our surveys or research activities, such as your survey responses.

  • Audio/Visual Information: security camera footage from our stores, voice recordings of conversations when you call our call center with questions, feedback, complaints, or otherwise.

  • Online Activity: Internet and other electronic network activity information, information regarding your interaction with websites, applications or advertisements, device data such as the operating system type of the device.

  • Geolocation Information: postal address, general location information (such as city, state or geographic area).

  • Inferences: inferences drawn from any of the information identified above to create a profile about you reflecting your preferences, characteristics, predispositions, behavior, attitudes, abilities, and aptitudes.

  • Other Information: information we may collect which we will use as described in the privacy policy or as otherwise disclosed at the time of collection.

 

We may use (and may have used during the 12-month period prior to the effective date of this Notice) your personal information for the purposes described in our U.S. Online Privacy Notice and for the following business purposes specified in the CCPA:

  • Performing services, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing advertising or marketing services, providing analytics services, or providing similar services

  • Auditing related to a current interaction with you and concurrent transactions, including, but not limited to, counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance

  • Short-term, transient use, including, but not limited to, the contextual customization of ads shown as part of the same interaction

  • Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity

  • Debugging to identify and repair errors that impair existing intended functionality

  • Undertaking internal research for technological development and demonstration

  • Undertaking activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by us, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by us.

During the 12-month period prior to the effective date of this Notice, we may have obtained personal information about you from the following categories of sources:

  • Directly from you

  • Your devices

  • Our affiliates

  • Vendors who provide services on our behalf

  • Online advertising services and advertising networks

  • Data analytics providers

We do not share or sell your personal information to third parties in exchange for monetary consideration. We may allow certain third parties (such as online advertising services or marketing analytics) to collect certain personal information (Identifiers, Online Activity, Inferences) for online advertising purposes and to provide third-party social network features and functionality on our sites and services. You have the right to opt-out of this disclosure of your information, which may be considered a “sale” under California law. Opt-Out of Sale: You have the right to opt-out of the sale of your personal information.

 

Shine the Light Request: You also may have the right to request that we provide you with (a) a list of certain categories of personal information we have disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year and (b) the identity of those third parties.

Verifying Requests. To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your personal information or complying with your request.  If you request access to or deletion of your personal information, we will need to have sufficient information to be able to verify your identity and the rights you have in the data subject to your request. In addition, if you ask us to provide you with specific pieces of personal information, we may require you to sign a declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request. 

 

Additional Information. If you choose to exercise any of your rights under the CCPA, you have the right to not receive discriminatory treatment by us.  To the extent permitted by applicable law, we may charge a reasonable fee to comply with your request.

 

International Users

As noted, this is a U.S. focused web site.  The Sites are not directed to users outside of the United State and are administered from the United States.  Information provided through the Site may be uploaded to a cloud and/or transferred to the U.S.    By providing information to the Sites you consent to the transfer, processing and/or use of the information to the U.S. and/or through a cloud.   In the event you utilize this site from outside of the U.S., you consent to the uploading of any information to a cloud and the transfer of the information to the U.S.

How We Protect Personal Information

We reserve the right to request information to authenticate your request.   We may take a reasonable period of time to respond to any request to update or modify any information, limit use of information or to opt out of or unsubscribe from any communications.   If you request the deletion,  modification or limitation of use of your personal information maintained by us we will promptly review your request and respond.   If we grant your request, such information may be retained for a period of time in our backup systems as a precaution against system failures.
